Man Sues Ex-Wife Because of Two Words She Wrote on Alimony Checks

A woman in Hopatcong may still be upset about her divorce. The woman was ordered to pay $186 per week in spousal support, and she's very conscientious about it.

However, some of the notes she makes to herself on the memo line have ticked off her former spouse, and he's suing her.

Diane Wagner, 57, writes different things in the memo line on her checks that she makes out to her ex-husband for spousal and child support. Some words she's used include 'bum' and 'loser.'

She's also written 'FOAD' on the memo line, which she says is a note to herself. Incidentally, it's also an acronym for "F--k off and die."

Diane seems to carry some resentment over the alleged drunken bouts she's had with her ex, Francis J. Wagner Jr.

Along with alimony and child support, the 61-year-old collects Social Security/Disability, and he claims that her notes have resulted in stress that has caused his health to decline even further.

He's not the only one who suffers from health problems. Diane suffers from brain cancer.

She is having trouble affording treatments and filed to have the amount of alimony/child support reduced, but a Superior Court family judge shot her down.

"As far as I'm concerned I can write anything I want on the memo line because it's a note to myself. I was the victim in that marriage. What more blood does he want from me? I pay him religiously," Diane told the Daily Record.

"A reasonable person under similar circumstances could not be expected to endure such harsh and extreme abuse that is being applied by the defendant in her compounding intentional acts designed to hurt the plaintiff," said the lawsuit filed by Francis.
