Woman Wins Divorce After Telling Judge About Toilet Incident

Divorce is far from a foreign concept these days, and most people have heard all sorts of reasons for ending a marriage. This one might not be new, but it's certainly rare.

There are a lot of things people in western nations take for granted, like indoor plumbing. In America, even the poorest of the poor usually have a bathroom with running water and a toilet. It can be shocking to hear about people living in other countries where something like a toilet is not a given, but one bride in India had to fight for her right to potty.

A woman in India took her husband to court after five years of marriage and had to fight for a divorce. In India, divorce is only granted if there is evidence of cruelty, violence or some other desperate situation.

This wife was able to convince the court that her lack of access to a toilet for five years amounted to cruelty.

Rajasthan’s Bhilawara district family court heard the case, in which the woman argued that it's 'mental torture' to live without a toilet, particularly for women. The woman said she first appealed to her in-laws about the struggles she was having without a toilet, but her pleas fell on deaf ears.

She finally decided to take her husband to court.

The woman argued that she'd been living with her own parents for the past two years due to a lack of toilet at her husband's home. Her husband and his family fought the divorce, but were unable to provide evidence of a toilet. The judge sided with the wife, and granted her the divorce.

“Has it ever pained us that our mothers and sisters have to go to defecate in the open? Women in villages have to wait for dark to venture out in order to relieve and as a result has to bear with physical pain,” said Judge Rajendra Kumar Sharma in the judgment.

In the 21st century, the judge sees it as a disgrace that so many homes in India still do not have toilets. “It is an irony that people who spend a lot of money on alcohol, tobacco and mobile phones, don’t have toilets in their homes,” he said.

About 600 million people, about half of India's population, do not have toilets, UNICEF reports. This is not only due to poverty, however.

While 70 percent of people lack toilets, only 10 percent of people lack cell phones. Many people in the country believe toilets are a source of germs, and they think it is unclean to have a toilet in the home.

It is custom in India for people to defecate out in the open. People will simply walk into fields or on the side of the road, squat and defecate.

Some women struggle holding it in until nightfall when they're less likely to be see because in going out and putting themselves in such a vulnerable position, women are in danger of getting sexually assaulted. Open defecation has also been behind the spread of many diseases.

For years, the government has been vowing to put an end to open defecation. The government has launched campaigns promoting the use of toilets, offered cash incentives to subsidize toilet construction, and even urged women to reject marriage proposals from men who did not have a toilet.

Since 2014, the government has constructed 20 million toilets. Prime Minister Narendra Modi vowed to put a toilet in every home by 2019, but thus far, progress in changing customs has been slow.
